Terms and Conditions of Use — Partidex

These terms govern the use of the “Partidex” mobile app for iOS and Android (identifier com.opharana.partidex) and of the pages of this website that open from its links: the group invitation and the recommendation (hereinafter, together, “Partidex”), owned by OPHARANA LLC, with its registered address at 99 Wall Street, Suite 1432, 10005, New York, United States, and email hello@opharana.com.

By downloading, installing or using Partidex, you accept these terms. If you do not agree with them, do not use it.

1. What Partidex is

Partidex is a score keeper for card, dice and board games. It lets you create groups with their players, whether they have the app or not; record the points of each game using a template’s rules or a free mode; and keep the group’s history and see its yearly leaderboard. The members of a group share their games.

Partidex is not a game of chance or a betting platform: it does not allow playing for money or prizes, and it must not be used to keep track of bets.

2. Minimum age

Partidex is intended for people aged 14 and over. By using it, you declare that you are at least that age.

3. Your anonymous account

Partidex does not require sign-up. When you open the app, an anonymous account is created that is tied to that installation. If you delete the app or switch phones, you lose access to that account and we cannot recover it, because we do not know who you are. You can rejoin your groups with their code: the games that had already been uploaded are still there, but those that were only on your phone are lost. You can delete your data at any time from Settings → “Delete my data” (details in the Privacy Policy).

4. Groups, content and conduct

The members of a group see its name, its players and its games, and can record new games in it. Only share a group’s link or code with the people you want to join: with it, anyone can join and see its games.

You are responsible for what you write in Partidex: the names of your groups and of the players you add. If you add someone who does not use the app, only enter a name or nickname that person agrees to. By using Partidex, you agree not to:

• Write content that is offensive, unlawful or infringes the rights of others, or personal data of third parties without their permission.
• Impersonate another person or join groups you have not been invited to.
• Modify the app, reverse engineer it, use external programs that interact with it on your behalf or attempt to access other users’ data.
• Create accounts, groups or games in bulk or for the purpose of obtaining rewards fraudulently.
• Interfere with the services Partidex depends on or use it for unlawful purposes or purposes contrary to good faith or public order.

We may delete content and groups that breach these terms.

5. The rules of the games

The templates follow the most widespread scoring rules for each game, which vary from one household to another. Check that the template matches the rules at your table or use free mode. Partidex keeps score, but it is not a referee: the result of each game is up to the people playing it.

The names of the traditional games that appear in Partidex (Chinchón, Mus, Brisca, Truco, Scopa, Burraco, Belote, Skat, Generala and Yatzy) are used generically. Partidex is not affiliated with any game publisher or its trademarks.

6. Free use and Partidex Plus

Without paying, Partidex gives you groups, all the templates, free mode, the history and the yearly leaderboard, with ads. Partidex Plus removes the ads and adds full stats, your own templates and card table themes. Plus is personal: it works on the store account of whoever buys it and is not shared with the other members of their groups. It is offered in two ways, with the price in your currency shown before you buy:

• Monthly subscription with automatic renewal. The amount is charged to your Apple or Google account when you confirm the purchase and then at the start of each month, unless you cancel the subscription at least 24 hours before the end of the current period.
• One-time lifetime payment. You pay only once, it does not renew, and it keeps Plus on your store account for as long as Partidex remains available in the stores.

How to cancel the subscription:

• iPhone: Settings → your name → Subscriptions → Partidex → Cancel Subscription.
• Android: Google Play → your profile picture → Payments & subscriptions → Subscriptions → Partidex → Cancel subscription.

When you cancel, you keep Plus until the end of the period you have already paid for and you are not charged again. Uninstalling the app or deleting your data does not cancel the subscription.

• Billing is handled entirely by Apple (App Store) or Google (Google Play), depending on your platform, under their own terms. We do not see or store your card or billing details.
• The digital content is delivered immediately after purchase. By agreeing to immediate delivery, you may lose the right of withdrawal that consumer law provides for digital content.
• Refunds and payment claims are handled through Apple or Google, not through us. If you have a problem with a charge, contact the support team of the relevant store.
• The purchase is linked to your store account. You can recover it with “Restore purchases” in the app, using the same Apple ID or the same Google account.
• We may change the price of Partidex Plus. If the subscription price changes, Apple or Google will notify you before it applies, and you will be able to cancel it.

7. A month of Plus for recommending Partidex

You can recommend Partidex with your recommendation link (partidex.com/r/ followed by your recommendation code, which is different from the code of your groups) or with that code. If someone uses your code when installing Partidex and then finishes their first game, each of you, that person and you, earns a month (30 days) of Partidex Plus.

Each person can only earn a reward once for using a code, and each person can earn a maximum of 12 months by recommending the app. You cannot use your own code. The months are added to any you already have and are checked by our server.

Free months have no monetary value, cannot be exchanged for money or transferred and do not affect a paid subscription, which keeps renewing until you cancel it. We may modify or end this promotion at any time, without affecting months already earned, and cancel rewards obtained fraudulently. We never reward ratings in the stores or posts on social media.

8. Advertising

The app shows Google AdMob ads and, when the app is in Spanish, in-house ads from TuIAgencia, the owner’s agency: a banner at the bottom and, when you finish a game, a full-screen ad, never in the middle of a hand. In the European Economic Area, the United Kingdom and Switzerland, you are asked for your consent before any Google ad is loaded. While Partidex Plus is active, no advertising is shown. The pages of this website have no ads. The details are in the Privacy Policy.

9. Service availability

Partidex lets you record games offline, but it needs an internet connection to create groups, join them and share games with their members. It depends on third-party servers and services, and we do not guarantee that it will work without interruptions or errors. We may modify, update or remove features and, if necessary, discontinue Partidex; if it were to be shut down permanently, we would announce it with reasonable notice in the app or on this website.

10. Intellectual property and license to use

Partidex, its code, its texts, its templates, its design and its graphic elements are owned by OPHARANA LLC or by third parties who have authorized their use. We grant you a personal, limited, non-exclusive, revocable and non-transferable license to use Partidex for private, non-commercial purposes. You may not copy, distribute or modify it or create derivative works from it.

The brand and the numbers use the Barlow Condensed typeface, by The Barlow Project Authors, under the SIL Open Font License 1.1. The app also includes third-party software under its respective open-source licenses.

11. Limitation of liability

Partidex is provided “as is”. To the fullest extent permitted by applicable law, the owner is not liable for indirect damages, loss of profits, loss of data (including games that were never uploaded) or harm arising from the unavailability of the service, from errors in the app or its templates, from your use of it or from what other users write.

Nothing in these terms excludes or limits liability that cannot be excluded by law, such as liability for willful misconduct, or the rights that consumer law grants to users acting as consumers.

12. Relationship with Apple and Google

These terms are entered into between you and OPHARANA LLC, not with Apple or Google. Apple and Google are not involved in the service and assume no responsibility for the app, its content, its maintenance or its support. In the case of iOS, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Changes to these terms

We may update these terms to reflect changes to Partidex or to applicable law. The version in force will always be the one published on this page, with its update date. If the change is substantial, we will let you know in the app. Continuing to use Partidex after publication means you accept the changes.

14. Governing law, jurisdiction and language

These terms are governed by Spanish law. For the resolution of any dispute, and where the applicable consumer law so permits, the parties submit to the courts and tribunals that have jurisdiction under the law. If you are acting as a consumer, you retain the right to bring proceedings before the courts of your place of residence. These terms are published in several languages; in the event of any discrepancy, the Spanish version prevails.
